Edward H. McCarthy

Edward McCarthy focuses his practice on general litigation, collective bargaining, student and employee discipline, internal investigations, student residency, land use, charter schools, and the representation of fire districts. He has represented school district and charter school clients in matters before the Commissioner of Education, the National Labor Relations Board, the New York State Division of Human Rights, the United States Equal Opportunity Commission, and the United States Department of Education’s Office of Civil Rights. Mr. McCarthy also served as Village Attorney for the Village of Bellport in 2008.

 

Mr. McCarthy has engaged in pro-bono representation for the Nassau-Suffolk School Boards Association in the defense of the Nassau County Tax Guaranty, and for the Brookhaven Town Safety Officers Association. He was also appointed to serve on the 2022 Redistricting Committee of the Town of Brookhaven.

 

Prior to joining Ingerman Smith LLP in 2007, Mr. McCarthy interned with the New York State Attorney General’s Office, Securities and Investor Protection Bureau, assisting in the investigation and prosecution of unlawful franchise offerings. He then served as an Assistant Suffolk County Executive, developing press releases, coordinating media communications, and acting as a legislative liaison. For four years, he was a Senior Assistant County Attorney with the Suffolk County Attorney’s Office, prosecuting child support and paternity proceedings, counseling the Suffolk County Executive’s office, and defending civil claims. From 2004 to 2007, he was an Assistant Town Attorney with the Town of Brookhaven, serving as counsel to the Zoning Board of Appeals and managing the defense of civil claims against the Town. 

 

Mr. McCarthy is also a regular guest speaker for the Suffolk and Nassau County Bar Associations Education Law Committee, presenting on topics such as student discipline, FOIL, FERPA, the Affordable Care Act, and cybersecurity/artificial intelligence.
